Progress report

(1) No new material has been posted by my attacker or his fans since the beginning of July.

(2) Most of the garbage has been removed from the web, but there are still search links that point to non-existent pages.

(3) Google still refuses to remove the original hate-blog without a court order--which they could challenge.

(4) The police and FBI have not been able to identify the perp, despite strong suspicions.

(5) My printer and booksellers have not caved into the threats by my attacker.

(6) My neighbors still talk to me and let their kids talk to me.

(7) My wife and dog still love me.

(8) I temporarily suspended publicity for my books until the bad publicity died down a bit, but I know the remnants will be online forever.

(9) I decided to remove the "Dirty parts easy to find" from the bottom of the front cover on my funny memoir. That line gave my attacker something to use in his campaign, and I also realize that it may make some readers uncomfortable. I may sell more books without the line on the cover. An important newspaper believes me

The Connecticut Post is Southwestern Connecticut's largest daily newspaper.

In Sunday's printed paper and now online, reporter Frank Juliano presents an extensive analysis of my attack, and concludes that I am not guilty of the ridiculous charges.

In the interest of accuracy, I must point out that (1) I am only 64 years old, not 65, and (2) I lost my virginity while in college, not in high school (but not for lack of desire or objects of desire).

While it's extremely satisfying to be investigated and vindicated by an important newspaper that's read by most of my neighbors who had been warned to keep their children away from me, my attacker is still free, as the police and FBI continue to investigate two months after the attacks began.

Photobucket did the right thing, promptly

Last week I noticed that my attacker had posted photos of me without permission on Photobucket, and the photos were linked to the original attack blog.

I complained to Photobucket on Saturday, and today the photos were gone from both Photobucket and Blogger.

I've been waiting for over a month for Google to cooperate.

My attacker put my photos on Photobucket

Photobucket is a very useful and easy-to-use free online service for storing, displaying and distributing photographs.

My attacker, using the name "Federaltorch," is using the site to display photos of me, my dog and my house. Two of the photos are displayed in violation of my copyrights, one violates the copyright of the Hartford Courant, and one violates a Google copyright.

My attacker has violated the Photobucket Terms of Use Agreement:

• 6.2 You represent and warrant that: (i) you own the Content posted by you on or through the Photobucket Services or otherwise have the right to grant the license set forth in this section, (ii) the posting and use of your Content on or through the Photobucket Services does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the posting of your Content on the Site does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of Content you post on or through the Photobucket Services.

An idiot commented about me

The New York Times website recently published "Ask the Experts: Managing Your Online Reputation" where Michael Fertik, founder of ReputationDefender, and Paul Ohm, a law professor at the University of Colorado, took reader questions about Internet privacy.

I explained my online ordeal, and at the end I mentioned that I was writing a book about it. It's quite common for authors to mention relevant books in online postings. There were 312 words in my posting, and just 17 dealt with the book.

Unfortunately, I received no useful advice from either Fertik or Ohm--but ignorant and belligerent "W. Smith" thinks that I wrote the book and then was harassed online.

HEY IDIOT: the book is being written about my attack. I had no reason to write it before I was attacked.

"Smith," in an effort to emphasize his intellect, says he "wasn't born yesterday."  He acts like he was born with anencephaly.

After over a month, Facebook did the right thing

On June 25, Facebook published a phony and dangerous petition aimed at having me put on the Connecticut registry of sex offenders. The petition was signed by a non-existent Mike Josephs and signed by seven non-existent supporters, and two real human beings who were scammed into supporting the cause.

"People" signing the petition called for my caging, castration and killing; and my Facebook friends were notified of the petition.

I complained to Facebook immediately--and frequently--pointing out that false identities were used in violation of Facebook policy, as well as copyright violation, libel, lies and calls for violence.

Today I received the following email:

Thank you for bringing this matter to our attention. We have removed or disabled access to the third-party or user-generated content you have reported to us for violating our Statement of Rights & Responsibilities.

I am certainly pleased and relieved that the Facebook attack has been removed. I'd be even more pleased if Facebook apologized for its unconscionable delay and told me how the company will stop similar attacks from happening again.

For the moment, lead petitioner "Mike Josephs" and his phantom flunkies Kendra, Johnathan, Melinda, Alice, Victoria, Billy and Harry are gone from Facebook.

I hope the real people on Facebook who were suckered into becoming their "friends" and aiding my harassment won't miss them, and they'll find some real live human beings to replace them

The young geniuses at Google have no common sense and no sense of decency. Google stupidly refused to remove a lying, harassing blog. Now I am fighting back, using Google, of course.

Don't get mad, get even write a book

Starting on 6/25/10, my small book publishing company, Silver Sands Books, and I became the targets of an elaborate online smear campaign.

I was unjustly portrayed as being a pornographer, dog rapist, child rapist, pedophile, wife burner, member of an international child porn ring, drunk driver, being listed on the California registry of sex offenders, using the Internet to "groom" children for sex, being investigated by the FBI, a threat to my neighbors...and more. The attacker's apparent supporters publicly called for my caging, castration and killing.

The attacker published two online petitions directed to Connecticut Governor Rell to try to get me put on the Connecticut list of sex offenders. Silver Sands Books was accused of publishing books for pedophiles. The attacker tried to get printer Lightning Source to stop printing and distributing my books, accused the printer of breaking the law, and threatened to sue them. My attacker falsely claimed that Amazon.com had stopped selling my books because I am a pedophile, My friends on Facebook and neighbors received messages accusing me of horrible crimes above.

The attack pointedly demonstrated how our cherished first amendment can be easily misused.

• Anyone can say anything about anyone.
• Some of the biggest and most successful online companies (e.g., Google) shield vicious, dangerous, libelous, lying criminals who use their services--and make it extremely difficult for victims to have the attacks terminated.
• People will believe anything they read online or on paper.
• Anyone can be an attacker--or a victim.

I responded by reporting the crime to the FBI and police, contacting my friends. contacting the website operators who published the lying harassment, blogging and--of course--starting to write a book about the ordeal.

Since I was attacked for my writing, it's only natural that I write about the attacks.

I hope the last chapter will be about my attacker going to jail.

I have been impressed by my attacker's intelligence as well as his craziness. This combination reminds me of a joke.

A driver hears a thumping sound from the right rear of his car, pulls over to the side of the road, walks around the car and discovers that he has a flat tire. He opens the trunk, removes his spare tire and jack, and starts setting up the jack to raise the car. At this point he notices that he is parked alongside a tall fence topped with barbed wire. There is a sign on the fence that says, "DANGER! Do Not Enter. County Home for the Criminally Insane." He looks through the fence and sees some obviously agitated people in orange jumpsuits approaching him. He assumes they will not be able to go over the fence but is nervous, anyway. He jacks up the car, removes the lug nuts and the tire, puts the good tire onto the car, and sees the four lug nuts rolling down a slight hill and then vanish into a sewer. Now he starts to panic.It's getting dark out. He is in the middle of nowhere. This is before cellphones were available. A crowd of crazies has assembled a few feet away from him, jumping, flailing and chanting incoherently. The driver feels doomed. Suddenly one of the inmates stops chanting and jumping and signals the driver to follow him along the fence beyond the other inmates to a spot where they can speak in quiet. The driver follows him and the inmate then says, "Hey mister, I have a suggestion. Each of the other three tires has four lug nuts. If you remove one lug nut from each tire and put it where you had the flat, each tire will be held on with three lug nuts and you'll be able to drive into town and go to the auto parts store to replace what you lost." The driver is very impressed, starts working on the other tires and when he finally secures the spare tire and puts the flat and the jack into the trunk, he walks over to his helper and touches his fingers through the fence to express his gratitude. He thanks him profusely, and also expressed his amazement. He says, "I just don't understand how an inmate of an insane asylum could come up with such a good idea." The man in orange said, "I'm glad to help. Remember -- just because I'm crazy, doesn't mean I'm stupid."

And that applies to my attacker. I hope he, too, is soon behind barbed wire and in an orange jumpsuit.

Why does my attacker care about my beard?

My attacker seems strangely obsessed with my appearance -- particularly my beard. Under his various fake names he has said that I am a "revolting beast" and a "sick hairy freak" with a "hairy beard" and I "look like a pervert."

Actually, I don' t look at all like Jeffrey Dahmer or the Marquis de Sade.

I haven't been a hairy freak in about 40 years, and I'm probably much less sick than my attacker is.

Perhaps he skipped biology class on the day his teacher revealed this, but BEARDS ARE MADE OF HAIR, so they are supposed to be hairy.

Some beards, of course, are hairier than others. My present beard, while hairier than the beards worn by Jobs, Lincoln and Lenin, is definitely mid-range -- about the same as Sigmund Freud's beard.

In addition to his obviously diminished mental capacity, perhaps my attacker also has low testosterone. Maybe he can't engage in sex and can't grow a beard -- so he's obsessed with my sex life and my beard. Maybe my attacker secretly wishes that he could rape dogs, little boys and teenage girls as he falsely accused me of doing. I guess we'll find out at the trial.

Protect America's Children

Is this a dirty picture that will incite lust in a pedophile?Would I really want to have sex with little boys and teenage girls and men and lesbians and a dog?

My online attacker, who uses multiple fake names including "Mike Josephs" and "Jonah Ark," wants people to believe that I put "half-naked images of children on the homepage" of one of my websites.

At the left is the photo he refers to. As you can see, the children are wearing modest bathing suits and are standing in a swimming pool.

The dog standing with them, however, is completely naked.

According to "Mike," a book I wrote "contains a disturbing account of bestial obscenity which contexts [sic] anal sex and sodomizing a dog called Hunter with a vibrating dildo."

That's my dog, Hunter, in the picture. I love him -- but not that way.

"Mike" also write that I contemplated sex with a "horny heterosexual male and lesbians."
 
So, here's the official tally of my lust objects: little boys, teenage girls, a heterosexual male, lesbians, and a Golden Retriever. What's next: a parakeet, a trout, or the tailpipe of a Honda Civic? Apparently no orifice is safe from me. Grand Canyon, watch out! 
 
I've also been accused of "grooming" children online for future sexual encounters, downloading child porn, and trying to attract other pedophiles.

My neighbors have been warned and the cops are watching my house. If you have a sexy parakeet or Honda, guard them carefully. A hot gerbil or lobster could be in jeopardy, too.

Be careful whom you befriend on Facebook

I get lots of requests to be a "friend" of people on Facebook and on other social networking sites. I'm a friendly guy and saw no point in rejecting anyone -- even people I had never heard of.

I've just learned that this policy is a big mistake, and can be dangerous.

Above at the right is a photo used by the fake "Mike Josephs" who sponsored a lie-based petition against me on Facebook, to have me put on a list of sex offenders.

Most of the people who signed the petition are just as fake as "Mike." There is no information on their Facebook pages, and they have no friends.

However, if people look at the page of "Mike," they will find some actual human beings listed as friends -- and these people unwittingly aid "Mike's" scams and crimes.

I wrote to all of "Mike's" alleged friends, asking if they really knew him or knew anything about him. The first reply I received was from Nikki Ganus. Nikki has over 1,000 listed friends, but she confirmed that she doesn't know or know about "Mike Josephs." She thanked me for the warning and  unfriended the phony "Mike."

Some people seem to get into friending frenzies, or contests to accumulate as big a friend list as they can -- without being aware of the consequences.

Prune your own list and advise your real friends and relatives to do it, too. Don't be associated with someone who can use your "friendship" to hurt others or commit crimes.

With friends like "Mike Josephs," you don't need enemies.

A little progress with Google

"Don't be evil" is the unofficial corporate motto of Google, but they don't seem to care if their products and services are used by others to be evil.

Google owns Blogger. Blogger hosts the blog you are now reading, and the blog that has been the main attack venue against me. That blog contains untrue, vicious, hurtful and absurd accusations (e.g.,  I was imprisoned in California for four years, I am on a government list of sex offenders, I am a danger to local children, I burned my wife and I raped two human beings and a dog). You can laugh at the last one.

This would seem to be pretty obvious defamation, a violation of Google's terms of service, as defined by Google, and a sufficient reason to have the blog shut down:

Google says:

What is Defamation?

•False and untrue communication published with the specific intent of injuring another person’s reputation
•Injured person must be identifiable

HOWEVER, as absurd and obviously defamatory as the blogger's claims are, Google lacks the confidence to make an official judgment of defamation and to protect my family from our online attacker and those he or she may incite.

The company says, "We do not remove allegedly defamatory content... The only exception to this rule is if the material has been found to be defamatory by a court, as evidenced by a court order.

I've tried to convince Google that the material is so obviously defamatory that they don't need a judge's declaration, but they are committed only to protect their corporate ass against a possible suit by their blogger, not to protect people injured by their blogger. 

I don't want to have to go to court to get a judgment. It will be costly, and could take a long time to get the judgment.

HOWEVER, Google has started to help me in one other way. While they lack the guts to accept the fact that I have been defamed and might be harmed or killed as a result, they are sensitive to claims that they helped a blogger to violate copyrights.

I have supplied evidence to them that my attacker's blog has violated multiple copyrights by posting copyrighted photographs without permisison. They deleted one page, and will likely delete some more.

Google has warned me, however, to "Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights."

• Google is more concerned about false claims for copyright infringement (and the opinions of Chinese government web censors), than about false accusations that I had sex with a little boy and a dog!

Hurray! Some good news for a change

I want to publicly thank my supporters, especially Emily Veinglory, who helped me to convince Yahoo to delete the hateful, destrucive and dishonest material that was promoted on MyBlogLog.com.

A few days ago Change.org and SheWrites.com were similarly wise and compassionate.

Unfortunately, Facebook has not yet responded to complaints, and Blogger (Google) insists that I must get a judge to officially declare that material on Blogger is defamatory.

I have been falsely accused of (among other things) raping a four-year-old boy, raping a 15-year-old girl, raping my dog (try not to laugh) and burning my wife with cigarettes.

I said to a representative of Google, "If that isn’t defamation, what is? If those accusations were made about one of your friends or relatives -- or Larry or Sergey [Google founders] -- would you think it was defamation, or need to consult a judge? Your policy has led to people calling for my caging, castration and killing. My business is suffering, my wife can't sleep, and she expects we will be murdered this coming weekend.

How my attacker violated his agreements with Yahoo, Blogger and Facebook

He agreed to not use Yahoo! to:

• upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
• impersonate any person or entity, including, but not limited to, a Yahoo! official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
• intentionally or unintentionally violate any applicable local, state, national or international law
• "stalk" or otherwise harass another

Violated Blogger rules include:

• Proper Use. You agree that you are responsible for your own use of the Service, for any posts you make, and for any consequences thereof. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations
• Impersonating others: Please don't mislead or confuse readers by pretending to be someone else or pretending to represent an organization when you don't.

My attacker is using the names of real organizations in his phony harassment and defamation campaign against me

He has no connection with the legitimate organizations using the "Protect Our Children" name. The primitive "child care" logo he invented is not used by any real group

My attacker is a pretty good opponent, but not my equal

I am an excellent hoaxer, with a long history of successful April Fools' Day spoofs and other creative fakery.

I do it for laughs, or sometimes to make a point.

Unlike the evil jerk who has been tormenting my family and me, my foolery has never resulted in death threats, castration wishes, loss of sleep, loss of business, depression, fear and the need to call the FBI and police.

I can appreciate a good scammer, and my opponent is a pretty good one. If my rating is 98, he's about 82 -- definitely above average. Even though he had me believing something in one of his blog posts for a few hours, he has a long way to go before breaking the 90-level.

He does a lot of research. He is obsessed with my writing, and searches for any tiny morsel he can choose to use as the basis for a hurtful lie. Of course, most of his lies come straight from his malfunctioning mind.

He's a pretty good writer, sometimes seeming like a journalist or an academic. He spells and punctuates better than many adults (but makes some really stupid errors). He uses a large vocabulary and appropriate cliches to enhance believability.

He's pretty good with computers. He set up a blog that doesn't allow any comments from readers, and where he is protected by a hosting company that denies all responsibility for harmful and dishonest content. He was able to temporarily block me from seeing his Facebook petition against me  The fake people he invented to sign the petition even have some real friends.

He is posing as a representative of the "Protect Our Children" organization, and sometimes sounds like a legitimate crusader who is concerned for the safety of children.

But when he writes that my house is "sleazy," and that one of my books is "sleazy" and has a "sick" tag line, and says I am a "scumbag," a "revolting beast," a "sick hairy freak" with a "hairy beard,"  and uses obviously fake identities to fill up his petitions against me, the creep loses all credibility.

His lies are so poorly executed that they make him look stupid.

He claims that there are "half-naked images of children on the homepage" of one of my websites. If anyone looks, they'll see two girls WEARING BATHING SUITS, standing in a swimming pool. Their mother was nearby, if it matters. Things that he says are in my books -- like dog rape -- are not in the book

He wrote that "Connecticut Police said yesterday they are investigating why the Pedophile is not on the child sex offenders registry in CT and have warned neighbors and local residents to stay calm and avoid Marcus, who was also a suspect in a domestic violence and DUI case dating back to December 1999 when his spouse was hospitalized with unexplained second-degree cigarette burns related injuries." Anyone who cares to check can determine that this is all warped fiction.

Hiding behind his feeble alias Mike Josephs, my attacker wrote. "Folks, it's further distressing that this CA registered pedophile and child molester, Michael N Marcus, has joined a young women's social network called SHEWRITES.COM. Why would an old man join a WOMEN'S social network? At this point it's difficult to ascertain whether this revolting beast has been grooming children /single mom's with young kids through the SHEWRITES.COM social network."

What the deceiver did not point out is that SheWrites members include old women, childless women, and even other men. The site is open to all writers. My attacker even joined under a fake female name -- but was exposed and thrown out!

His petition calls for me to be added to the "Connecticut Sex Offences Register." There is no such thing, and in the United States the proper spelling is "Offenses." He foolishly uses the British spelling and skips the period after my middle initial when writing under his multiple phony identities.

Now that I've analyzed this, I'll lower his score to 65. Once he's arrested, it drops to zero. I hope he's put away for 20 years to life.

Meet Alice. She wouldn't recognize the truth if it bit her nose

Sweet amateur detective "Alice Clark" wrote, "We've confirmed that Michael N. Marcus has a conviction for sexually abusing a young boy 15 years ago, but does anyone have any more info on his police cautions for downloading child porn?"

She managed to insert a period after my middle initial, so she may actually be a disciple of the lead liar, instead of the liar himself.

"Harry James," an apparent solid citizen, says, "We as Americans need to act. Congress is going to have to start taking this problem seriously, there are TOO MAY UNREGISTERED PEDOPHILES LIKE MICHAEL MARCUS falling off radar. You can't get much more serious that child rape. He's registered in California as a pedophile and convicted sexual offender with a forensic history as long as my arm. Is he a wife beater as well? Meet Melinda. She wants my balls cut off.

"Melinda Tufnell" signed a petition on Facebook directed to the governor of Connecticut, asking to have me put on the state's registry of sex offenders.

This sweet lady wrote, "Pedophile Michael N Marcus is another depraved, nasty deformity who has a registered history of disturbing child sex offences and sick pedophilia convictions, parading as an "upstanding pillar" of the community. This case exemplifies exactly why Obama needs to enact a complete overhaul of the child protection regulations in our country starting at the federal level with a focus on data handling of registered pedophiles, rapists and sex pests across the States. Castrate this sick hairy freak and put it in a cage where it belongs. I'm tweeting this to my colleagues."

Interestingly, "Melinda" omits the period after my middle initial, and types "offences" instead of "offenses" -- just like the lying creep who is in charge of the campaign against me.

Of course there is no information on Melissa's Facebook page -- because she does not exist.

Rape is a horrible, horrible crime that can cause lifelong emotional and physical damage. Some victims have said that rape is worse than death.

In some places, rape victims are ostracized or even killed.

Two of my books being sold by Amazon.com are about telecommunications, two are about publishing, two are humorous memoirs. None of them include pedophilia, bestiality or rape.

For a while on Tuesday it seemed that my books were banned by Amazon because of complaints by a lying lunatic; but along with others authors I was a victim of a computer glitch which made books temporarly unavailable.

The petition is addressed to my governor, M. Jodi Rell, and says "Michael N Marcus is a Registered Child Molester, Sex Offender and Pedophile. He is currently living in the Milford Area of Connecticut, with schools and kindergardens within a 50 mile radius of his house."

While it is true that there are a great many schools within 50 miles of my home, I am absolutely NOT a child molester.

None of the public-spirited do-gooders shown above know anything about me, or made any effort to verify the facts before signing the petition, or to consider the possibility that someone might read the petition that they supported and KILL ME.

WOW. More good news. I'm feeling a bit better.

I just saw a wonderfully supportive blog post by Tyge on The Neon Lounge. I've never met Tyge, but apparently he has been reading my bookmaking blog, and has learned to believe me and trust me.

While it's nice to have support from friends and relatives, it's even nicer to have support from strangers.

Ultimately we are all members of the same organization -- The League of Potential Victims.

I've previouslyy written that "anyone can sue anyone for anything." If you can afford the cost of a lawyer, or the filing fee for a "pro-se" suit, then truth, justice and legitimacy are simply not considerations before attacking someone in court.

With websites claiming to be neutral "common carriers," with no perceived need to verify the content they publish or to consider the ramifications of publication, now anyone can say anything about anyone, and possibly reach millions!

I am certainly a supporter of free speech and freedom-of-the-press. It's ironic that the freedoms that have greatly benefited me, can also kick me in the ass.

As long as I don't get murdered by some crazed citizen whose emotions are stirred up by the still-unknown scamster, I can live with a bruised behind. It's better than sacrificing free speech.

HOWEVER, I do wish that the folks who publish websites with "open admission" would be a bit more careful about whom they allow to use their facilities.

HURRAY! Some good news for a change

When I arrived at my PC a few minutes ago to once again check Google for reports about my phony criminal past, I was saddened to see that there were now TWO LINKS -- not just one -- to items on SheWrites.com.

However, when I clicked on the links, I was relieved to reach "page was not found" notices. Apparently my plea to the ladies who run the website was listened-to and believed.

And, as a sweet glob of whipped cream on my ice cream, I see that the bogus "Caroline Harris" who manipulated SheWrites to publish the slander, is no longer listed as a member.

THANK YOU, MY SISTERS!

I hope that the other websites that were similarly abused will be similarly cooperative.

I can't help having a cynical smile at the website's automated notice that says. "OUR APOLOGIES" because the offensive and untrue pages are no longer available. It would be nice if I got an apology.

I hate this crap

It's now the beginning of day-four of the siege. I hate my new life. Every few hours I use Google and Bing to search for Michael Marcus plus "pedophile" and "molester" to detect new little fires to be squirted at before they become raging conflagrations that can embarrass my family and damage my business.

As I've searched for myself and phony news, I've encountered links to "Michael Jackson" and "molester," and Dallas Cowboy "Marcus Dixon" and "rape."

While I have absolutely no sympathy for real criminals, especially child molesters, I have to wonder how many other folks have been falsely accused of crimes -- and beaten or lynched by mobs or executed by governments -- for things they did not do.

I also wonder if the attack on me was deliberately scheduled to coincide with the one-year anniversary of the death of the most famous alleged pedophile who was also named Michael.
